Apple granted administrative stay in eBook monitor appeal

According to a report in Reuters, Apple has been granted an administrative stay by the 2nd U.S. Circuit Court of Appeals in New York. Apple filed the appeal after Judge Denise Cote denied Apple’s motion to remove Michael Bromwich from his position as compliance monitor in Apple’s eBook settlement with the Department of Justice. This short stay relieves Bromwich from his position while a federal panel of three judges decides whether the stay should remain in place while pursues a formal appeal. The DOJ did not oppose the administrative stay, but will continue to fight Apple as it tries to remove Bromwich. The DOJ has until January 24th to file opposition papers before the panel rules on the possibility of a permanent stay. Apple has been unhappy with Bromwich from the moment of his appointment as compliance monitor. The company claims Bromwich overstepped his bounds when he asked to meet with executives and board members. Apple also opposed his excessive fees, which are being billed at a rate of $1,100 per hour.
